Shari’ah (Islamic Laws) and Prevailing Laws Concerning to Admission: A Critical and Comparative Study

Abstract

Disputes and differences are part of human society. No society is free of these problems. All societies have certain rules to resolve these disputes. Like other countries, Pakistan has also a system of law courts to settle such issues. The courts resolve these issues on the ground of certain proofs such as evidences, oaths and witnesses etc. Admission is a part of judicature. Pakistani judicature has laws concerning to admission. While Shari’a has also laws for the said purpose. Now, it is important to see whether these methods are compatible to Islamic laws or not. The article under study is presenting a comparative analysis of the both laws. As Pakistan is an Islamic Republic and Islam is the state religion, the findings of the article will guide towards the Islamization of these laws if there is some difference or clash between the two.
