Principles and Etiquettes of Fatwa Writing in Islamic Shari’ah and Current Issues

Abstract

Progress in human life is a natural process as a result of which man also suffers from difficulties. Sometimes these problems are so complex that the average person seems helpless to solve them. A Muslim seeks a fatwa from scholars to resolve problems arising out of religious and worldly affairs. Various rules and etiquettes have been laid down in Islamic law for issuing fatwas. This article examines the teachings on fatwa in Islamic law. The need for fatwas for Muslim scholars to suggest solutions to various problems in human life and the Islamic principles and rules related to it. Also, the importance of the dissertation, its objectives, research methods, research questions, previous discussions on this topic, etc.The decision of a Shariah expert in Shariah matters is called a fatwa. A person who has knowledge of the Qur'an and Sunnah and who knows the rules of Shariah, when he offers a Shariah solution to an issue or an ambiguous event, it is called a fatwa.There are some rules and regulations for writing a fatwa in Islamic law that every mufti needs to know. They relate to the practice of fatwas, writing fatwas, original fatwas and etiquette fatwas.It is a fact that a fatwa is meant to solve problems. Where it solves problems, it also faces problems. The current system of fatwa writing faces many challenges, some of which are as follows:Sectarianism, terrorism, misuse of the commandments, rebellion against the Islamic State, takfiriyyah, unavailability of aunts of books, tolerance of muftis, unavailability of consensus forum.
